Florida Sen. Marco Rubio (R-Fla.) on Thursday framed the Supreme Court’s decision to uphold the healthcare law as evidence that President Obama violated a campaign promise not to raise taxes on the middle class.

“What the Supreme Court has said is the reason why it’s constitutional is because it’s a tax increase, something that Barack Obama specifically denied publicly,” Rubio said in an interview with Univision. “If you don’t buy health insurance, the IRS is going to come after you.”

The freshman senator and potential vice presidential candidate keyed in on Chief Justice John Roberts’ rationale that the law’s requirement that individuals purchase health insurance or face a financial penalty is constitutional on the grounds that it is a tax.

As a result, Rubio accused Obama of breaking a campaign promise not to raise taxes on individuals earning $250,000 or less per year.

But in his criticism of the law, Rubio was careful not to criticize the Court led by Roberts, an appointee of President George W. Bush.

“It’s important to remember that what the Supreme Court decides is whether this is constitutional or not, not whether it’s a good idea,” Rubio said.
